Arbitration Bill was introduced into the Legislative Council on 26 June 2009. Its main proposals are:-
(a) to give certain provisions of the Model Law of the United Nations Commission on International Trade Law (UNCITRAL Model Law), subject to modifications and supplements, the effect of law in Hong Kong;
(b) to unify the existing domestic and international regimes of arbitration and to repeal the Arbitration Ordinance (Cap. 341); and
(c) to make provisions for other related and consequential matters.
Sections of particular relevance to the construction industry are Section 100 and Section 101.
Section 100: Opt-in provisions automatically apply in certain cases
Section 101: Opt-in provisions that automatically apply under section 100 deemed to apply to Hong Kong construction subcontracting cases
